Repeated, Extended Absences from Work for Medical Appointments Qualify for Disability in California

The California Fair Employment and Housing Act (“FEHA”) prohibits an employer from discriminating against or failing to accommodate an employee because of a physical disability. A physical disability under the FEHA includes “any physical neurological impairment that limits a major life activity.” Repeated absences from work for medical appointments amount to a limitation on the major life activity of working where the employee shows that he has a physical impairment that is potentially disabling enough for the employer to accommodate him at his place of employment.
